General Terms and Conditions
Article 1 – Definitions
For the purposes of these terms and conditions, the following definitions apply:
Withdrawal Period: the period within which the consumer may exercise the right of withdrawal.
Consumer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
Day: calendar day.
Duration Transaction: a distance contract relating to a series of products and/or services, the delivery and/or acquisition of which is spread over time.
Durable Data Medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of Withdrawal: the possibility for the consumer to withdraw from the distance contract within the withdrawal period.
Entrepreneur: the natural or legal person offering products and/or services remotely to consumers.
Distance Contract: a contract concluded within an organized system for distance selling, where exclusive use is made of one or more means of distance communication until the contract is concluded.
Means of Distance Communication: a method that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same location.
General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.
Article 2 – Applicability
These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between entrepreneur and consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed that the terms can be consulted and will be sent free of charge upon request.
If the contract is concluded electronically, the terms may be provided electronically in such a way that they can be stored on a durable data medium.
If additional product or service-specific conditions apply, the most favorable provision for the consumer shall prevail in the event of conflict.
If one or more provisions are invalid, the remainder of the agreement remains valid, and the invalid provision will be replaced with one that most closely reflects the original intent.
Situations not covered shall be interpreted in the spirit of these conditions.
Article 3 – The Offer
If an offer has limited validity or is subject to conditions, this will be explicitly stated.
Offers are non-binding. The entrepreneur may amend or adapt offers.
Product descriptions are complete and accurate. Images represent products as faithfully as possible. Obvious errors do not bind the entrepreneur.
All images and data are indicative and cannot give rise to compensation or contract termination.

Article 4 – The Contract
The contract is concluded upon acceptance of the offer and fulfillment of its conditions.
Electronic acceptance will be confirmed immediately. Until confirmation, the consumer may withdraw.
The entrepreneur ensures secure electronic data transmission.
The entrepreneur may verify the consumer’s creditworthiness and may refuse orders for justified reasons.
The entrepreneur will provide in writing or via durable medium:

Termination conditions for long-term contracts
All contracts are subject to product availability.
Article 5 – Right of Withdrawal
The consumer may withdraw within 14 days without giving reasons. The period begins the day after receipt.
Products must be handled with care and returned in original condition where possible.
The consumer must notify withdrawal within 14 days (written/email) and return within 14 days after notification.
Failure to comply makes the purchase final.
Article 6 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer.
Refunds will be processed within 14 days, provided the product has been received or proof of return is supplied.
Article 7 – Exclusion of Withdrawal
Withdrawal may be excluded for:

Custom-made products

Clearly personal items
-
Non-returnable goods
-
Perishable goods
-
Market-price dependent goods

Newspapers/magazines

Opened sealed audio/video/software
-
Opened hygienic products
Services excluded include:

Accommodation, transport, catering, leisure on specific dates

Services started with explicit consent

Betting and lotteries
Article 8 – Price
Prices remain unchanged during validity unless VAT changes apply.
Market-dependent products may fluctuate.
Price increases within 3 months are only permitted by law. Beyond 3 months, only if agreed or consumer may withdraw.
For deliveries outside the EU, import VAT and customs clearance are the responsibility of the recipient.
Printing errors are not binding.

Article 10 – Conformity and Warranty
Products comply with agreement, specifications, reasonable quality requirements and laws at time of contract.
Defects must be reported within 14 days.
Warranty does not apply if:

Product altered/repaired by consumer or third party

Improper handling
-
Damage due to abnormal conditions
-
Government regulations affecting materials
Article 11 – Delivery and Execution
Orders are executed with care.
Delivery address is the one provided by the consumer.
Orders are fulfilled within 30 days unless agreed otherwise.
If delivery is impossible, a replacement may be offered.
Risk transfers upon delivery to consumer.
Article 12 – Duration Transactions
Indefinite contracts may be terminated with one-month notice.
Fixed-term contracts may be terminated at end of term with one-month notice.
Automatic renewal rules apply as described.
Article 13 – Payment
Payment must be made within 7 working days unless otherwise agreed.
Errors in payment details must be reported immediately.
Reasonable costs may be charged in case of late payment.
Article 14 – Complaints
Complaints must be submitted within 7 days of defect discovery.
Response within 14 days.
Valid complaints may result in repair or replacement free of charge.
Article 15 – Disputes
All agreements are exclusively governed by Dutch law, even if the consumer resides abroad.
Article 16 – CESOP
Following the implementation of amendments to the Dutch VAT Act (1968) regarding payment service providers and the Central Electronic System of Payment Information (CESOP), payment service providers may register transaction data in the European CESOP system.
